According to paragraph 19, section 2(e) of the Personal Data Protection Act (GDPR), the person concerned (customer/website visitor) is obliged to provide personal data for the purpose set out below, otherwise it is not possible to conclude the contract in which the person concerned has expressed an interest.

  1. The purpose of the processing of personal data, as well as the legal basis for processing personal data:

Purpose: conclusion of the contract and pre-contractual communication

 

Legal basis:

Article 6 section 1(b) of the Regulation (EU), and paragraph 13 section 1(b) of the Personal Data Protection Act: the processing of personal data is necessary for the conclusion of a contract to which the person is a party, and for the communication prior to concluding the contract based on the person’s request,

Article 6 paragraph 1(c) of the Regulation (EU), and paragraph 13 section 1(c) of the Personal Data Protection Act: the processing of personal data is required under certain circumstances, e.g. the provider/seller is obliged to provide the personal data of the person concerned to some state institutions in accordance with special regulations.

 

The seller/website owner hereby informs the customer/website visitor that, in the process of concluding the contract, he will process personal data without the consent of the person concerned, since the processing of personal data will be carried out within the framework of pre-contractual communication, and the processing of personal data is necessary for concluding the contract, and the provider/seller is also obliged, in accordance with special regulations, to provide the personal data of the person concerned to state institutions.

The seller/website owner declares that he will process personal data in accordance with good morals and will act in a manner that does not contradict the Personal Data Protection Act or the Regulation (EU).

 

  1. Identification of the recipient or category of recipient

Recipients or categories of recipients who process personal data are:

The seller, the website provider, transport companies, IT support, state institutions to which the seller/website owner has legal obligations: tax office, control and supervision office (e.g. Slovak Trade Inspection, Office for the Protection of Personal Data), executor, lawyer, court, law enforcement agency, etc.

 

  1. Length of storage of personal data

How long we store personal data: your personal data will be stored for at least 24 months. This is a period determined by law and arising from the concluded contract (e.g. according to paragraph 599, section 1 of the Civil Code, the buyer can exercise his rights to return defective goods within 24 months of the receipt of the goods – the storage of personal data is thus necessary for the identification of the contracting party). Personal data can also be stored until it is not possible to exercise rights and obligations within the limitation period established by law. Keeping personal data for more than 24 months is only possible for the purpose of archiving, for scientific purposes, for the purpose of historical research or for statistical purposes based on a special regulation.

The customer or website visitor has the following rights (GDPR):

  • The right to data access – You have the right to request copies of your personal data.
  • The right to data rectification – You have the right to request that we correct any information you believe is inaccurate. You also have the right to request that we complete the information you believe is incomplete.
  • The right to data erasure – You have the right to request that we erase your personal data, under certain conditions.
  • The right to restrict data processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.
  • The right to object to data processing – You have the right to object to our processing of your personal data, under certain conditions.
  • The right to data portability – You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.
  • The right to submit a motion to initiate proceedings or a complaint to the supervisory authority. You have the right to submit a proposal or a complaint to the Personal Data Protection Office of the Slovak Republic, https://dataprotection.gov.sk, Hraničná 12, 820 07 Bratislava 27; e-mail: statny.dozor@pdp.gov.sk.

The person concerned can request to exercise the above-mentioned rights at any time via e-mail, or in writing to the postal address of the seller/website owner. The seller/website owner will handle the request of the person concerned in connection with the above-mentioned rights within legal deadlines.
